The Civil Court has ruled that it will proceed with a case seeking compensation over delays in handing over an apartment under The Gardens housing project, rejecting a jurisdictional objection raised by the Housing Development Corporation (HDC).

The case was filed by Hussain Hameed, who is seeking compensation after an apartment purchased from Jaah Investment Pvt Ltd was not handed over by the agreed deadline in December 2019.

HDC argued that the agreement was between the buyer and the developer, Jaah Investment, and that it was not a party to the contract. However, the Civil Court ruled that the case should proceed and instructed HDC to submit its formal response by 7 August.

The Gardens project was launched by Jaah Investment in 2017 but faced repeated delays. HDC later terminated its agreement with the developer after the project remained incomplete despite multiple deadline extensions. The remaining construction work was subsequently awarded to Rashid Carpentry and Construction (RCC).
