The Parliament’s Judiciary Committee has forwarded the case of Criminal Court Judge Hussain Faiz Rashad to the full parliament for a decision on his dismissal.
The Judicial Service Commission (JSC) had recommended the dismissal, stating that Judge Faiz violated the constitution and laws in determining the remand of Ali Anwar Mohamed. The JSC asked the parliament to approve the dismissal under Article 142 of the Constitution, Article 33(b) of the Judges Act, and the Judges Code of Conduct.
The matter was reviewed by the Judiciary Committee, chaired by Speaker Abdul Raheem Abdulla. PNC MP Ashraf Rasheed said the committee found no procedural violations by the JSC and noted that Judge Faiz had not raised any complaints regarding the process. The motion to refer the dismissal to the parliament floor was seconded by North Feydhoo MP Ismail Nizar and passed unanimously by the committee.
Judge Faiz was suspended by the JSC in November 2021. He presided over the case in which former President Abdulla Yameen Abdul Gayoom was sentenced to prison over the leak of an audio clip allegedly involving the judges handling the trial.
