The Judicial Service Commission (JSC) has decided to submit a motion to Parliament seeking the dismissal of Criminal Court Judge Hussain Faiz Rashad.

According to the JSC, the decision follows findings that Judge Faiz acted in an unconstitutional manner when issuing a ruling on the remand of an individual held in police custody. The commission stated that his actions breached established constitutional procedures.

Judge Faiz was suspended by the JSC on 22 October after investigations into two separate cases. One involved the release of Ali Anwar Mohamed, 41, from S. Hithadhoo. The other concerned the continued detention of Halimath Lamha, who remains in custody pending trial in connection with the murder of Mary Grace.

This is not the first time Judge Faiz has faced disciplinary action. He was previously suspended by the JSC in November 2021. The same year, former President Abdulla Yameen Abdul Gayoom was sentenced to prison following a Criminal Court case involving a leaked audio clip allegedly featuring the judges overseeing his trial.

The motion for dismissal will now move forward to Parliament for further consideration.
