A proposal has been made to the parliament floor to empower the Judicial Service Commission (JSC) on their decision to disobey the order from the Supreme Court on 12 June 2019 to stop the investigation into the Supreme Court Judge, Abdulla Didi.
The proposal was made along with the report from the parliament’s judicial committee after the JSC was summoned to the committee for a statement on 13 June.
Head of the Judicial Committee, MP for North Maafannu constituency, Imthiyaz Fahumee presented the report stating that the JSC statements show that the members face obstruction in doing performance reviews of the judges, investigating disciplinary issues and entering the Supreme Court in their official capacity.
And so, the decisions made by JSC are fully supported by the Constitution and so support the JSC claim that the Supreme Court order on 12 June 2019 negates that authority of the JSC.
The motion also advises on the Supreme Court not to interfere with the work of other state institutes.
A disciplinary case was filed with the JSC against Judge Didi by the Speaker of the Parliament, former President Mohamed Nasheed. The JDC then decided to suspended the Supreme Court Judge which prompted the Supreme Court order to drop the investigation.
