The Prosecutor General’s Office on Tuesday forwarded Information Commissioner’s Office (ICOM)’s case against the government for police investigation.

President's Office (PO) Chief Spokesperson Heena Waleed, in response, said that ICOM's request under Right to Information Act (RTI) against PO was unrelated to the current administration. She added that the PG request pertains to a Covid-19 vaccination information in 2019.

According to the RTI Act, if 45 days have passed without appealing a decision of the Information Commissioner or implementing it, the information commissioner can approach the PG office with a request to be sent to the court for treatment of the person in accordance with the procedure followed by disobeying the legal order.

According to the PG Office, Shifan Ahmed of the Information Commissioner's Office has submitted the case with relevant documents as 45 days have passed without appealing the information commissioner's decision in connection with the President's Office case.

However, since the Criminal Procedure Code says that the offence contained in every criminal case committed by the state should be adequately investigated and the investigation is carried out by the accused in accordance with the provisions of the Code of Criminal Procedure, the local police service is legally empowered to conduct the investigation.

"Therefore, we have requested the police office to investigate the matter as per law and send it along with the investigative findings to find out if there is any criminality in the complaint filed by the Information Commissioner," the PG office said.
