The Supreme Court has ordered the reinstatement of 10 administrators who were sacked by various courts five years ago.
The case was heard by the Employment Tribunal after 10 court administrators of some magistrate courts, family court and criminal court and senior court administrator of the High Court filed a petition with the Department of Judicial Administration (DJA) seeking reinstatement.
They said the DGA's decision to dismiss them was in violation of the Employment Act, international norms and the Judicial Staff Rules.
Therefore, the tribunal was asked to quash the decision and not to consider them dismissed from their jobs at the time.
After considering the case, the Employment Tribunal ruled that the dismissals could not be relied upon after establishing objective and procedural justice. Therefore, the dismissal of these persons is unfair and they should not be considered as dismissed persons and they should be paid the salary and allowances of the posts held at the time of dismissal till the date of resumption of employment.
The tribunal also ordered the DGA to notify the Employment Tribunal in writing within three days of the implementation of the matter within 30 days from the date of the decision of the tribunal on 26 October 2021.
However, the JSC was unhappy with the tribunal's decision and appealed to the High Court.
The High Court ruled that there was no judicial or legal reason to quash the tribunal's decision on the appeal. However, the JSC appealed to the Supreme Court against the High Court's decision.
The Supreme Court today ruled that there was no need to change the High Court's judgments in the cases.
