The High Court has ruled that the Information Commissioner was right to ask FENAKA to disclose the details of their debt.

The Information Commissioner ordered FENAKA to disclose the amounts and details of the payments to various parties in October last year. However, FENAKA refused and appealed to the High Court.

FENAKA reasoned that if the information is disclosed, it would also release the the information of those who have signed agreements with FENAKA.

The High Court yesterday ruled that FENAKA could not explain if it would violate the principle of confidentiality by disclosing the amounts and details of its payments to various parties.

As such, the High Court, which heard the case, ruled that the Information Commissioner's order to disclose the debt details of FENAKA should not be changed. The bench was presided over by Justice Faisal.
