High Court rules they have no jurisdiction to hear the case seeking to dismiss and nullify the Government's policy on defining Male' residents for social housing.
Housing Ministry has publicised a policy on defining Male' residents who would qualify for the Government's 'Binveriya' scheme for 3,000 land plots. As per the policy, Male' residents would be people who have never been registered elsewhere at any point of time.
Lawyer and Managing Director of SJ Construction, Shihadh Ibrahim and Hassan Falah, Fuvahmulah City, filed a case with High Court to nullify the policy set by the Government. The motion filed with the court stated that such definitions limit the rights of people who have lived in Male' City and have been since registered there.
The motion also stated that the policy by the Government to define the Male' residents contradicts with Articles 41 - Clause 2, 3 - 20, 17, 16, 68 and 69 and contradicts clause 138 of Decentralisation Act and clause 98 of Companies Act as well.
As such, Shihadh and Falah filed a case with High Court to nullify the policy defining Male' residents for social housing scheme.
Attorney General's Office stated that the case does not fall under the purview of High Court and as such, the Court cannot proceed with the case hearing.
