Director General of the National Counter Terrorism Centre (NCTC), Major General (Retired) Wais Waheed, has lost his bid to stop the handover of a SIFCO flat previously seized from him. The flat, identified as C1301, was transferred to another party after the Civil Court ruled against Waheed in 2019.

Waheed had filed a case on August 8, 2019, requesting the Civil Court to order SIFCO to return the flat. However, on September 16, 2019, the court found no legal basis to claim he had violated the agreement with SIFCO. Waheed immediately appealed the ruling at the High Court, seeking a temporary injunction to prevent the flat from being given to someone else.

According to Waheed’s lawyers, SIFCO informed them that it would sign an agreement to transfer the flat within an hour of the Civil Court’s verdict. Waheed argued this was done to block his appeal and undermine his request for a temporary order.

SIFCO responded that the agreement with Waheed had already been terminated by court order, leaving no basis for legal protection under the previous contract. The organization noted that ownership of the flat had already been transferred, and issuing an injunction would harm both the new occupants and SIFCO.

Presiding Judge Abdul Maniu Hussain stated that the agreement to transfer ownership was finalized on September 16, 2019, the same day Waheed sought the injunction, meaning third-party rights had already been established. He ruled that there was no ground to issue a temporary order in Waheed’s favor. Justices Huzaifa Mohamed and Ibrahim Mahir supported the decision.

The High Court delivered a unanimous verdict denying Waheed’s request for temporary relief.
