High Court has warned the Prosecutor General on potential legal action, since her stand on certain ongoing trials were changing during different phases of trial.
High Court’s waring came during a verdict on the appeal case of ex MNDF member Ahmed Thiham – who was allegedly involved in the bombing of Finifenmaa launch.
During the trial hearing today, Justice Mohamed Niyaz noted that for certain cases, verdicts of lower courts were supported by the PG however during the appeal hearings of these cases, the state’s stand was being changed saying earlier verdicts were wrong. He then proceeded to ask state prosecutor whether they had a different stand in the said trial – which was responded to as none.
Justice Niyaz then went on to ask state prosecutor Ahmed Naushad whether it was the PG who was taking different stands during appeal hearings of certain cases. Even though Naushad responded with a clear no, Justice Niyaz noted that it had come to his attention that her stand was changing during different phases of trial and added that this was a serious issue if true.
He further added that legal action could be taken against her if such things continue.
While High Court has warned the PG of potential action, her stand had indeed changed in the terror trial of former Vice President Ahmed Adeeb.
The PG had noted that the verdict issued by the Criminal Court and High Court in Adeeb’s terror trial was wrong, during the appeal hearing of the case held at the Supreme Court. The PG justified this by saying that the verdicts were found to be wrong during a study into the evidence of the case, and had since asked to change the verdict.
However, the Criminal Court and High Court based their verdicts on the evidence and statements provided by the PG.
